Honorable Ambassador,

 

We are deeply concerned about the recent situation of Asian immigrant workers especially workers from Bangladesh in Kuwait .  A huge number of Bangladeshi workers have been already deported from Kuwait in last couple of days. Workers staged strike rightfully demanding better pay and decent treatment.

 

Bangladesh has strong political and religious ties with Kuwait ; also we had a significant contribution for Kuwait during gulf crisis in the early 90's.  We completely respect the internal law and order systems of Kuwait , but in the mean time we also would like to see that workers are getting benefits per the international labor laws (guided by International Labor Organization, ILO)..  As far as we understand there is no fair minimum wage enforced in Kuwait (like the USA and many other countries) and we would like to request the Honorable Government of Kuwait to take necessary steps that would enforce a fair minimum wage as well as good working environment in Kuwait .

 

We would also like to humbly remind that there are millions of Bangladeshi workers around the globe and they are working everywhere with great reputation.  The agitation by mostly unskilled workers in Kuwait does not represent typical working culture of Bangladeshi workers.  We strongly believe a better working environment would make sure more professional workmanship from our workers.

Hello friends,

I am Rhishikesh Dave, Registrar of Gujarat National Law University. We are organizing our first international moot court competition and we are looking for contributions from all who are engaged in legal education and have a specialization in international law. We welcome proposals for being a judge in the competition or contribute by forming problems for the moot. Kindly let me now your ideas and make some inputs to make this event a grand success. The event will be held in the last week of January 2009.

Here is a brief introduction to our university and the moot court.

1st GNLU International Moot Court Competition

Gujarat National Law University, Gandhinagar (GNLU) is one of the seven premier Indian Law Schools in India which has contributed substantially towards revolutionizing legal education in India into professional legal education. GNLU is a member of the consortium comprising of seven prestigious Indian National Law Schools which organized the Common Law Admission Test this year. The University offers integrated five years graduation programme with stream specific specialization viz. B.Com, LL.B. (Hons.), B.A., LL.B. (Hons.) and B.Sc., LL.B. (Hons.) The University also offers LL.M programmes for dedicated higher education in law.

GNLU is organizing the 1st GNLU International Moot Court Competition from January 22-25, 2009. The theme of the Moot Court Competition would be based on the area of Public International Law (PIL) involving aspects of International Trade Law with the forum of adjudication being International Court of Justice (ICJ).
One of such area on which the moot problem can be based is:
Free Trade Agreement (FTA) is one of the most hotly debated issues in current scenario. Especially with the current stalemate in the WTO negotiations, FTA's & Regional Trade Agreements (RTA's) are being considered as the way forward. Therefore the moot problem can be based on situation where some countries enter into a Treaty. The Treaty would have a clause whereby the signatories' countries would be asked to enhance economic cooperation among the member countries by entering into a FTA.

Things to Note

Since the FTA has been entered pursuant to a treaty, any violation of the FTA would amount to a violation of the treaty thereby invoking the jurisdiction of International Court of Justice (ICJ) as this is issue between 2 sovereign nations. In this we would also mention that one of the countries is not a party to WTO which would ensure that the matter would be heard in ICJ only.. Furthermore in this problem, there would be issues related to the violation of right to privacy which is a part of Human Rights Law. The problem also includes Vienna Convention on Law of Treaties, 1969 and other aspects of Public International Law.
Since under International Law, the availability of legal literature about Trade Law is quite scarce, we can mention that case laws and legal provisions of GATT, GATS would act as a subsidiary source of law for the adjudication of the Dispute.
